Court to Deliver Ruling on GISBH CEO and Wife's Habeas Corpus Challenge on Jan 14
JOHOR BARU — The High Court has set January 14, 2025, to deliver its decision on the preliminary objection to the habeas corpus application filed by GISB Holdings (GISBH) CEO Datuk Nasiruddin Mohd Ali and his wife, Datin Azura Md Yusof, who are challenging their detention under the Security Offences (Special Measures) Act (SOSMA) 2012.
Federal counsels argued that the application was an improper use of the judicial system and should instead be addressed through judicial review. The petitioners' legal team, led by Datuk Rosli Kamaruddin, contends that the habeas corpus challenge raises critical legal issues, including the timing of the charges brought against the couple.
Nasiruddin, 65, and Azura, 57, were charged in October with being members of an organised crime group, along with 19 others, under SOSMA. If the objection is overruled, the court will proceed to hear arguments on the merits of their detention.
The case has drawn attention due to its implications under Malaysia’s organised crime laws, and the petitioners’ team plans to appeal for reconsideration of the charges.
