A 58-year-old palm fruit harvester was fined RM3,000 by the Sessions Court here after pleading guilty to posting an obscene comment about a surgeon's daughter on Facebook three years ago.Judge Ahmad Fuad Othman fined the accused, Ahmad Nasir Khadir, RM3,000 and ordered six months' jail if he fails to pay the fine.Before sentencing, the judge warned the accused to be more responsible online.“There are no restrictions on posting online, but defamatory or offensive content is monitored by the Malaysian Communications and Multimedia Commission (MCMC),” he said.Ahmad Nasir was charged with posting a sexually offensive comment with intent to annoy, using a Facebook account named 'Pro Nasir'. The post was detected on January 3, 2023, at 11:52 AM on the 8th floor of the MCMC headquarters in Cyberjaya.He was charged under Section 233(1)(a) of the Communications and Multimedia Act 1998, which carries a penalty of up to RM50,000, one year in jail, or both upon conviction.The judge emphasized that social media should not be used as a platform for obscene comments and cited recent cases where fines ranging from RM7,000 to RM9,000 were imposed for similar offenses.
