The Attorney General's Chambers (A-GC) is not disputing the existence of a royal addendum that could allow Datuk Seri Najib Razak to serve the rest of his prison sentence under house arrest. Instead, they challenge the procedure of submitting this addendum as new evidence in Najib’s judicial review at the High Court.
Senior Federal Counsel Shamsul Bolhassan said proper procedures must be followed when introducing new evidence. Najib’s lawyer, Tan Sri Muhammad Shafee Abdullah, argued that the A-GC should confirm or deny the addendum’s existence at the leave stage instead of calling it speculative. He emphasized that Najib only obtained the addendum after receiving palace consent, and acted promptly to submit it in court.
Najib, serving a six-year sentence for misappropriating RM42 million, seeks a court order compelling the government to confirm and disclose the addendum dated Jan 29, 2024. His original 12-year sentence was halved and the fine reduced after a royal pardon.
