Malaysia’s Federal Court has agreed to revisit a landmark decision that allowed prisoners, already granted pardons for death sentences, to still seek judicial reviews. In a 4-1 majority ruling, a five-member panel led by Chief Justice Datuk Seri Wan Farid Wan Salleh granted leave to the prosecution to challenge the earlier ruling. The case now raises questions over whether the courts have jurisdiction to review decisions made by the Pardons Board. Supporting the majority were top judicial figures, including the President of the Court of Appeal and Chief Judges of Malaya and of Sabah and Sarawak. Only Federal Court Judge Datuk Rhodzariah Bujang dissented.
